Collaborative Law is a new and unique approach to dissolving your marriage in a dignified and private manner. Collaborative Law is different from litigation because the parties control the process, not a judge. Collaborative Family Law is a form of alternative dispute resolution in which the attorneys and the parties work together to resolve whatever disputed issues there are without legal conflict or court battles.
The collaborative approach creates a non-adversarial atmosphere of open communication and cooperation that assists the parties in reaching a settlement that best meets their needs and the needs of the children during the separation process and in the future. Unlike traditional family law, Collaborative Family Law offers you the option of retaining a team of trained professionals that may include financial specialists, divorce coaches and child specialists.
In the collaborative process, the parties work with their attorneys and neutral professionals as a team to find a mutually beneficial resolution to the issues in their divorce or other family law matter. The parties collaborate to resolve their case, agree to stay out of court, freely exchange financial information and strive to be as amicable as possible while working together to reach a resolution.
To participate in the collaborative process, each party needs his or her own family law attorney who is trained in the collaborative process. Each party and their respective attorney will sign an agreement which states that they will not resort to litigation to resolve their differences, and if they do, their collaborative attorneys must withdraw. Regular meetings are held during which the team works to help the parties resolve their family law case. If successful, the only court appearance is likely to be the presentation of final documents.
Collaborative law can be used in a variety of family law conflicts, including:
Dissolution of marriage (divorce)
Child custody/parenting time
Child support
Modification of custody and/or child support
Maintenance (spousal support)
Visitation disputes
Paternity
Dissolution of domestic partnerships
